Court documents: Bullet from murder suspect’s gun, not officers’, killed young girl

LEAVENWORTH COUNTY, Kan. — Court documents released on Tuesday reveal how investigators say a five-year-old girl died after prosecutors say her mom’s boyfriend kidnapped the girl.

Police say Marcas McGowan kidnapped Cady Harris last July. Two officers and McGowan started shooting at each other after a high-speed chase from Atchison, Kan., to Leavenworth.

Court documents reveal Harris died from a bullet to the back of the head and investigators believe McGowan shot her. Investigators say they found a spent 9-millimeter round in the front seat area of the SUV McGowan had been driving, and added he’s the only person in the shootout who had a gun with a 9-millimeter round, specifically a “Jennings Nine” semi-automatic handgun.

Until Tuesday, it had not been revealed how the young girl was killed, though McGowan has been charged with first-degree murder because the girl was killed while he was allegedly committing crimes. Officers were cleared of wrongdoing last August following a Kansas Bureau of Investigation probe.

In addition to murder, McGowan also faces charges of aggravated kidnapping, aggravated assault, aggravated endangering of a child, criminal possession of a firearm and fleeing and eluding law enforcement.
