OLATHE, Kan. — The family of Jamie Frecks, the young woman who died when she fell out of a party bus onto I-35 last month, has filed a lawsuit against the bus company for wrongful death.
Attorneys Lynn R. Johnson and David R. Morantz filed the lawsuit in The District Court of Wyandotte County.
They released the following statement.
“Companies that transport passengers for-hire must follow regulations designed to protect public safety. Those regulations are often dismissed as heavy-handed government intervention. Hopefully, this case will highlight importance of those regulations and ensure that other companies comply with safety requirements so that future tragedies are prevented.”
After inspecting the bus, federal regulators determined the party bus on which never should have been on the road. They also ordered the company, Midnight Express LLC, stop operating immediately.
Investigators said this particular bus was so unsafe it should not have even been on the road without passengers.
However, the night of May 4, Jamie Frecks, 26, and 16 of her friends were on the bus for a girlfriend’s bachelorette party. Frecks fell out onto I-35 near the Southwest Blvd. exit and was hit by at least three cars and was killed. She was a new mother of a two-month-old daughter.
