BONNE TERRE, Mo. (CNN) — The U.S. Supreme Court has granted a stay of execution for a Missouri death row inmate. Herbert Smulls was scheduled to be executed on Wednesday morning at 12:01. Justice Samuel Alito wrote the stay order late Tuesday night.
“It is ordered that execution of the sentence of death is hereby stayed pending further order of the undersigned or of the Court,” Justice Alito wrote.
Smulls is on death row after being convicted of Chesterfield, Mo. jeweler Stephen Honickman’s murder. Our affiliate KTVI is reporting that Smulls’ lawyers claim the state is using a “substandard” drug compound in its lethal injection of Smulls.
