(CNN) — The Montana Supreme Court on Tuesday ordered a re-sentencing for a former teacher who served a month behind bars for raping a 14-year-old girl, ruling that he shouldn’t have served anything less than two years in prison.
The case involves former teacher Stacey Dean Rambold, who authorities said raped a girl in 2007. The girl, Cherise Morales, who attended the Billings, Montana, high school where Rambold taught, committed suicide in February 2010, before the case went to trial.
Rambold pleaded guilty to sexual intercourse without consent, and last year a judge sentenced him to 15 years in prison, with all but 30 days suspended. That meant serving 30 days in jail and more than 14 years on probation.
The state Supreme Court heard the case after prosecutors appealed the sentence.
