Official Rules

Sponsors. This sweepstakes (“Sweepstakes”) is sponsored by WDAF (“Station”), 3030 Summit, Kansas City, MO 64108, and Bob Hamilton, 7899 E Frontage Rd., Overland Park, KS 66214 (collectively, the “Sponsor(s)”). This Sweepstakes is void where taxed, restricted, or prohibited and is subject to all local, state, and federal laws. By entering this Sweepstakes, each entrant accepts and agrees to be bound by these Official Rules and the decisions of the Sponsor(s), which shall be final and not subject to appeal.

APPLE IS NOT INVOLVED IN ANY WAY IN THIS CONTEST/SWEEPSTAKES. THE SPONSOR(S) IS/ARE SOLELY RESPONSIBLE FOR PROVIDING THE PRIZE(S) LISTED HEREIN. THE PRIZE(S) WON ARE NOT APPLE PRODUCTS, NOR ARE THEY RELATED TO APPLE IN ANY WAY. THE RESPONSIBIITY OF ORGANIZING THIS Sweepstakes AND DISTRIBUTING THE PRIZE(S) ARE THE SPONSORS’ RESPONSIBILITIES. Eligibility. No purchase necessary to enter. The Sweepstakes is open to permanent legal U.S. residents who reside within 50 miles of WDAF (address above), who are at least 18 years of age and are the record owner of a foundation based single family residence (houseboats, mobile homes and tiny homes are not eligible), located within 50 miles of the Station, at the time of entry. Proof of homeownership may be requested by the Sponsors at any time during this Sweepstakes. Failure to provide valid legal documentation will result in disqualification or forfeiture of the prize. Current or former employees of WDAF, Nexstar Media Group, Inc. and its subsidiaries, the other Sponsors, the other television and radio stations and multichannel video programming distributors in WDAF’s viewing area, their parent companies, subsidiaries, affiliates, advertising or promotional agencies (including anyone who prepares and/or distributes Sweepstakes materials), and the immediate family members or persons living in the same household (whether related or not) of all the foregoing are not eligible to participate or win. The term “immediate family members” includes spouses, grandparents, parents, siblings, children and grandchildren.

Participants are eligible to win a WDAF contest or sweepstakes only once (1) every 60 days. Only one (1) winner per household is permitted in any contest or sweepstakes. Participants are eligible to win a prize valued at $600.00 or more only once (1) every six (6) months. Text, data, or messaging rates may apply.

Entry. This Sweepstakes will accept entries beginning on September 7, 2020 at 4:00 AM CT and ending on October 7, 2020 at 11:59 PM CT. To enter the Sweepstakes, entrants must visit https://nxstrib-com-staging.go-vip.net/wdaf/contests/ to submit the entry form. Entrants must include their name, address, phone number, e-mail address and date of birth in order to enter. Incomplete entries will not be considered. All entries must be received by October 7, 2020 at 11:59 PM CT. One (1) entry per person per day will be accepted.

Sponsor(s) is/are not responsible for technical or computer, telephone service outages, delays, equipment malfunctions, busy signals, hang-ups, errors or data loss of any kind, lost or unavailable connections, or late, lost, failed, illegible, incomplete, garbled or deleted entries, transmissions, or voicemails or other network or technological difficulties that may prevent an individual from completing his/her telephone call or online entry, or for printing errors in any advertisement, entry form, or the rules.

An entrant may use only one email address to submit entries during the Sweepstakes. If an entrant uses multiple email addresses to submit more than one entry per day, the entrant will be disqualified. For entries submitted online, entries will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the e-mail address by an Internet access provider, online service provider, or other organization that is responsible for assigning the e-mail address or the domain associated with the submitted e-mail address. Any automated or computer-generated entries, fake or duplicate identities, spam, or improper techniques (as determined by the Sponsor(s)) will be disqualified. Any questions regarding the validity, completeness, or number of entries submitted by an individual or the identity of the authorized account holder of an e-mail address, phone number, or social media profile shall be determined by Sponsor(s) in its/their sole discretion. The Sponsor(s) reserve(s) the right to disqualify any entrant who acts in a disruptive, harassing, vulgar, or unsportsmanlike manner, as determined by the Sponsor(s) in its/their sole discretion.

Entry materials that have been tampered with or altered are void. If the Sponsor(s) determine(s), in its/their sole discretion, that there is any suspected or actual tampering with the Sweepstakes (electronic or otherwise) or if technical difficulties (e.g. infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor(s)) compromise the security, fairness, integrity or administration of the Sweepstakes, the Sponsor(s) reserve(s) the right to void the entries at issue and/or modify, suspend, cancel or terminate the Sweepstakes and conduct a random drawing to award the prize among all eligible entries received as of the termination date. If the Sweepstakes is terminated due to tampering or technical difficulties prior to its expiration date, notice will be posted online at https://nxstrib-com-staging.go-vip.net/wdaf/. Sponsor(s) reserve(s) the right to disqualify any entrant that tampers with the operation of the Sweepstakes or website or violates the Official Rules of the Sweepstakes. Entries not conforming to announced entry specifications will not be acknowledged or returned.

All entry information becomes the property of the Sponsor(s), and entrants grant the Station the right to distribute all of their entry information to the other Sponsor(s). By entering, entrants grant the Sponsor(s) the right to broadcast and distribute their name, image, likeness, voice, entry materials, and biographical information in any media whatsoever, including on the air on the Station and on https://nxstrib-com-staging.go-vip.net/wdaf/, for any purpose whatsoever, worldwide, in perpetuity, without any further authorization from or compensation to the entrant. Odds of Winning. The odds of winning depend on the number of eligible entries received.

Prize(s). There will be one (1) winner in this Sweepstakes. On October 8, 2020 at 9:00 AM CT, the winner will be randomly selected from all eligible entries and notified that they won by phone or e-mail. The winner will receive a non-transferable nonconvertible gift certificate, redeemable at Bob Hamilton Plumbing, Heating & A/C, located at 7899 E Frontage Rd., Overland Park, KS 66214, for the following:

1. Grade R60 attic insulation (up to ADD SQFT)

The potential winners will be contacted by a representative of the Sponsors, and must reply within 24 hours to maintain eligibility. If a potential winner cannot be contacted within this time period or fails to respond to any attempted contact, such potential winner will be disqualified, his/her entry will be declared null and void and the Sponsors reserve the right, in their sole and absolute discretion, to choose another potential winner by the process referred to above.

All results are unofficial until winner(s) is/are verified by the Sponsor(s). Prizes may not be exchanged, substituted, transferred or redeemed for other prizes by winner. Cash will not be awarded as a substitute for prize. Prizes are awarded ‘as is’ with no guarantees or warranties as to use, merchantability, or fitness for a specific purpose, and the Sponsor(s) is/are not responsible for defective prizes. Sponsor(s) reserve(s) the right to substitute a prize in their sole discretion without an on-air or off-air announcement, in which case a prize of equal or greater value will be awarded. Conditions for Acceptance of the Prize(s). The winner must claim the prize(s) in-person at the Station, located at 3030 Summit, Kansas City, MO 64108, during regular business hours (Monday – Friday from 7:30 AM CT – 4:30 PM CT). Prize(s) will not be mailed under any circumstances. Unless otherwise notified by Sponsors, the prize(s) must be claimed by October 21, 2020, at 4:30 PM CT or it/they will be forfeited. Winner will be required to provide a valid government issued photo identification card and to execute an affidavit of eligibility and publicity and liability release prior to receiving their prize(s). The Station may require the winner’s guests, invitees, or travel companions to sign liability releases prior to receiving the prize. All unclaimed or rejected prizes will be forfeited. Failure by the winner(s) to respond to the Station’s messages, calls, e-mails or other notification will lead to forfeiture of the prize(s). Failure to completely fill out and sign all waivers, releases, or forms requested by the Station will result in forfeiture of the prize(s). The Station then has the right, at its discretion, to award that prize to another winner using the method described above. A winner who forfeits any prize is not eligible to win another contest or sweepstakes conducted by the Station for thirty (30) days.

Payment of all federal, state and local taxes is the sole responsibility of the winner(s) and the winner(s) may receive an IRS 1099 Form or equivalent from the Sponsor(s). The Sponsor(s) will report any individual winnings over $600 (in cash or fair market value of goods or services) in a one year period to the Internal Revenue Service. Winner(s) is/are required to fill out any tax forms requested by the Sponsor(s) in order to receive their prize(s).

Winner(s) will be solely responsible for any and all license and registration fees, accommodations, transportation costs, gratuities and all other items of an incidental nature. All expenses on receipt and use of prize(s) are the sole responsibility of the winner(s), the Sponsor(s) is/are not responsible for any weather changes or extenuating circumstances relating to a prize received. The Sponsor(s) is/are not responsible for replacing or reimbursing winners with any form of compensation for events that are delayed or canceled. All delays and cancellations are deemed beyond the control of the Sponsor(s). This includes, but is not limited to, event cancellations, trip schedule changes, flight cancellations, changes in travel arrangements, travel delays of any form and duration, game cancellations and delays, as well as all acts of nature. The Sponsor(s) is/are not responsible for any expenses incurred by Sweepstakes winners as a result of such delays or cancellations. Sponsor(s) will not be responsible for failure to supply the prize(s) by reason of any force majeure events, such as acts of God, war, terrorist attacks, unusually severe weather, labor strikes, or other causes beyond the control of the Sponsor(s).

By accepting the prize, the winner or winners agree to have their name, voice, likeness, biographical information, and entry materials used in any advertising or broadcasting material relating to this Sweepstakes, and in any media whatsoever, including the Station and on https://nxstrib-com-staging.go-vip.net/wdaf/, for any purpose whatsoever, worldwide, in perpetuity, without any further authorization or compensation to the winner(s).

Social Media. For contests or sweepstakes conducted or promoted on Facebook, Twitter, Instagram, YouTube, Snapchat, iHeartRadio, or any other social media website (each a “Social Media Site” and collectively the “Social Media Sites”), the Sponsors reserve the right to void any entrant’s entry in the Sweepstakes for failure to abide by the guidelines, policies, or procedures of the applicable Social Media Site, and to delete or remove any of entrant’s related “Likes,” comments, posts, tweets, videos, photos, user generated content, or other electronic messages, communications, or submissions at their discretion. The Sponsors also reserve the right to block, ignore, report, and/or completely prevent any entrant, account, user, or profile from accessing the Sweepstakes and/or the Sponsors’ profile(s), account(s), website(s), blog(s) or handle(s). Limitation on Liability. Sponsor(s) disclaim(s) all liabilities to the winner(s) with respect to receipt and use of the prize(s). Winners and their guests or travel companions, by acceptance of their prize(s), agree to release and hold the Sponsor(s) and its/their affiliated companies, their advertising, promotion and production agencies, and their respective parent companies, subsidiaries, affiliates, officers, shareholders, directors, employees, agents and representatives harmless from any and all liability, claims, causes of actions, damages, fines, and costs of any kind whatsoever (including reasonable attorney’s fees) which may be sustained directly or indirectly to persons or property in connection with the receipt, ownership or use of the prize or while preparing for, participating in, and/or traveling to any Sweepstakes or prize-related activity.

Reservation of Rights. Sponsor(s) reserve(s) the right to make changes to these Official Rules in their sole discretion which will become effective upon announcement. Sponsor(s) reserve(s) the right to cancel or terminate this Sweepstakes for any reason in the event that it cannot be run or administered as intended by the Sponsor(s). The term “immediate family members” includes spouses, grandparents, parents, siblings, children and grandchildren.

Participants are eligible to win a WDAF contest or sweepstakes only once every 60 days. Only one winner per household is permitted in any contest or sweepstakes. Participants are eligible to win a prize valued at $600.00 or more only once every six months. Text, data, or messaging rates may apply.

Entry.This Sweepstakes will accept entries beginning on July 13, 2020 at 12:00AM CST and ending on September 27, 2020 at 11:59PM CST. Photo Restrictions.Photos submitted by the entrants/participants may not contain, as determined by the Sponsor in its sole discretion, any content that:
is obscene, offensive, sexually explicit or suggestive; violent; derogatory of any ethnic, racial, gender, religious, professional or age group; endorses any form of hate or hate group; profane or pornographic; contains nudity;
promotes alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing); promotes any activities that may appear unsafe or dangerous; promotes any particular political agenda or message;
contains products or trademarks of any Sponsor competitor;
defames, misrepresents or contains disparaging remarks about any person or company;
contains trademarks, logos, or trade dress (such as distinctive packaging or building exteriors/interiors) owned by others, without permission, to the extent permission is necessary; contains any personal identification, such as license plate numbers, personal names, e-mail addresses or street addresses;
contains copyrighted materials owned by others (including, without limitation, photographs, sculptures, paintings, and other works of art or images published on or in websites, television, movies or other media), without permission, to the extent permission is necessary;
contains materials embodying the names, likenesses, voices, or other indicia identifying any person, including, without limitation, celebrities and/or other public or private figures, living or dead, without permission, to the extent permission is necessary;
contains look-alikes of celebrities or other public or private figures, living or dead;
communicates messages or images inconsistent with the positive images and/or good will to which Sponsor wishes to associate; and/or
violates any law or regulation.

By entering this Sweepstakes, entrant acknowledges and agrees that all entries become the property of the Sponsors and will not be returned or acknowledged. To be eligible, an entry must be the entrant’s original photograph, may not have been entered in any other Sweepstakes, won any other prize or have been previously published in any other medium. In connection with an entrant’s submission, the entrant affirms, represents, and/or warrants that: (i) you own or have the necessary licenses, rights, consents and permissions to use and authorize the Sponsors to use all copyright, trademark or other proprietary rights in and to such submission to enable inclusion and use of the submission in the manner contemplated by these Sweepstakes rules; and (ii) if applicable, entrant has the written consent, release and/or permission of each and every identifiable individual person in the submission to use the name or likeness of each and every such identifiable individual person to enable inclusion and use of the submission in the matter contemplated by these Sweepstakes rules. Sponsor(s) reserve(s) the right to request proof of these permissions in a form acceptable to Sponsor(S) from any entrant at any time. Failure to provide such proof will render entry null and void.

Prize(s).There will be one (1) winner per week in this Sweepstakes.Each Saturday and Sunday during the 7AM and 8AM newscasts, a randomly selected winner will be announced from all eligible entries and notified that they won by phone or e-mail. The winner(s) will receive 5 Turkey Hill vouchers for 48 ounce ice cream containers. The approximate retail value of the prize(s) is $30.00. Entrants can win only once.

The potential winners will be contacted by a representative of the Sponsors, and must reply within 72 hours to maintain eligibility. If a potential winner cannot be contacted within this time period or fails to respond to any attempted contact, such potential winner will be disqualified, his/her entry will be declared null and void and the Sponsors reserve the right, in their sole and absolute discretion, to choose another potential winner by the process referred to above.

Conditions for Acceptance of the Prize(s).The winner(s) must claim the prize(s) in-person at the Station, located at 3030 Summit, Kansas City, MO 64108 during regular business hours (Monday – Friday from 7:30 AM CST – 4:30 PM CST). Prize(s) may be mailed under special circumstances. The prize(s) must be claimed by October 5, 2020 at 4:30 PM CST or it/they will be forfeited. Winner(s) will be required to provide a valid government issued photo identification card and to execute an affidavit of eligibility and publicity and liability release prior to receiving their prize(s). The Station may require the winner’s guests, invitees, or travel companions to sign liability releases prior to receiving the prize. All unclaimed or rejected prizes will be forfeited. WDAF will conduct the, “FOX4 Weather Quiz Giveaway Rules 2019” (“Sweepstakes”) in accordance with these Official Rules (“Rules”). The Sweepstakes is intended for play in the United States only and is void where prohibited and outside the eligibility area set forth below. Do not participate if you are not eligible and located in the United States at the time of entry.

1. Eligibility: Entrants must be legal US residents, at least 18 years old, as determined by WDAF and reside in the Kansas City Designated Market Area as defined by The Nielsen Company. Employees of WDAF and of its parent and affiliated companies (collectively, the “Sponsor”), the Sweepstakes participating sponsors, promotional agencies, advertising agencies, and any other entity involved in the development or administration of this Sweepstakes, employees of other television or radio stations, and members of the immediate families of such persons are not eligible to participate and win. The term “immediate family” includes spouses, siblings, parents, children, grandparents, grandchildren, and any other person residing at the same household whether or not related. 3. Sweepstakes Entry: To enter the Sweepstakes, watch WDAF’s 7-8 AM CT morning newscast weekdays during the Sweepstakes Period for broadcast of “Weather Quiz Questions” then go to fox4kc.com/contest by noon CT that day and complete the official entry form, submitting your name, age, email and that day’s “Quiz Answer.” The entry form must be complete including the correct “Quiz Answer” for that day. One entry per person and per email address per Weather Quiz Question (for a total of 255 entries per person); subsequent daily entries from the same person (even if using different email addresses) or a single email address will be disqualified if discovered by Sponsor. Entrants must use their own name. Incomplete entries will be disqualified.
Entrants may be required to become registered users of the WDAF website (registration is free). Multiple daily entries by means of software-generated or other automated processes will be disregarded if discovered by Sponsor and may be voided in Sponsor’s sole discretion. Only one registered account per entry. If multiple accounts are detected for a single entrant, the accounts will be void and the entries disqualified in Sponsor’s sole discretion. If there is a dispute as to the identity of an entrant, the authorized account holder of the email address used to enter will be deemed to be the entrant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winner may be required to show proof of being the authorized account holder. The information that you provide in connection with the Sweepstakes will be used by Sponsor in accordance with its Privacy Policy, which is found at privacy.tribunemedia.com and which may be updated from time to time. If Sponsor is unable to run the Weather Quiz on any given day because of breaking news or other unforeseen circumstances, Sponsor will announce the action as soon as possible, and no alternate Weather Quiz will be given that day.

4. Winner Selection: After the close of each Entry Period, one winner will be selected for that Entry Period from among all eligible entries received for that Entry Period. After the close of the Sweepstakes Period, the Grand Prize winner will be selected by random drawing from among all eligible entries received during the Sweepstakes Period. Odds of winning will depend on the number of eligible entries received for each drawing. Entries will not carry over from one Entry Period to the next, except that all valid entries received during the Sweepstakes Period will be eligible for the Grand Prize.

5. Winner Notification and Verification: Sponsor will attempt to notify the winner by email and/or phone the Monday or Tuesday following the drawing date. All winners are subject to eligibility verification and compliance with these Rules. Winner is subject to verification by WDAF of the winner’s name, age, address, phone number, and Social Security number (where the prizes won from Sponsor in a calendar year are equal to or greater than $600.00). In order to claim his or her prize, winner may need to appear in person during regular business hours at WDAF TV FOX4, 3030 Summit, Kansas City, MO 64108 weekdays between 7:30 am CT and 4:30 pm CT by no later than 14 days after the drawing date. Winner may be required to sign an Affidavit of Eligibility/Release of Liability and Publicity, provide a valid photo ID, and may be required to provide a completed W-9, per Section 9 below. Potential winner must have a valid email address and phone number where the potential winner can be notified. If a potential winner: (a) does not respond within 24 hours of initial notification attempt, (b) is unavailable for prize fulfillment, (c) is not in compliance with these Rules, (d) fails to provide required information and documents by deadlines established by Sponsor, or (e) does not meet the eligibility requirements, Sponsor reserves the right to award the prize to another winner selected by random drawing from among remaining eligible entrants for that drawing, time permitting. If Sponsor cannot find an eligible winner for the prize, that prize will not be awarded. All results are unofficial until winners are verified.

6. Prizes: There is prize one per Entry Period. Each prize is a pizza/gift card from Minsky’s. Approximate retail value (“ARV”) of a prize is: $25.00. There is one Grand Prize. The Grand Prize is free pizza for a year, which will be awarded in the form of a $1,300 gift card from Minsky’s. ARV $1,300. Total ARV of all prizes: $2,575. Gift cards subject to terms and conditions thereon.

7. Prize Acceptance/Restrictions: Limit one prize per person and one winner per household, except that a winner can win an Entry Period prize and the Grand Prize. Prizes cannot be redeemed for cash or substituted for any other items by any winner. Prizes are non-assignable and non-transferrable. Sponsor reserves the right to substitute a comparable prize of like or greater value, including cash, for any prize, for any reason. Costs of transportation and any other cost not specifically included in the prize are the sole responsibility of the winner. All properly claimed prizes will be awarded, but in no event will Sponsor award more prizes than are provided for in these Rules.

8. Publicity Release: By participating in the Sweepstakes, each entrant acknowledges that his/her entry in the Sweepstakes constitutes that entrant’s consent to use, publish, reproduce and for all purposes, including publicity, promotion and advertising, in any media (including without limitation, the Internet, television or offline promotions), each entrant’s name, likeness, photograph, voice, opinions, and/or hometown and state, and any portion thereof in connection with the Sweepstakes, each extending throughout the universe and in perpetuity without further compensation, credit or right of review or approval, except where prohibited by law.

9. Taxes: Any valuation of the prize(s) stated above is based on available information provided to WDAF, and the value of any prize awarded to a winner may be reported for tax purposes as required by law. All taxes, including federal, state, and local taxes, are the sole responsibility of the winner. Any person winning more than $600.00 in total prizes will be sent a 1099 form by the Sponsor at the end of the calendar year, and a copy of such form should be filed with the IRS. Each winner must provide Sponsor with valid identification, and a valid taxpayer identification number or Social Security number for total prizes won from Sponsor in a calendar year valued at $600.00 or more, before any prize will be awarded. Sponsor will have the right, but not the obligation, to require any winner to complete and submit an IRS form W-9. Sponsor reserves the right to withhold prizes until the completed W-9 form is received.

10. Conditions: Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend this Sweepstakes or any portion hereof, or to disqualify any individual implicated in any of the following actions, if: (a) infection by computer virus, bugs, tampering, unauthorized intervention, actions by entrants, fraud, technical failures, or any other causes which, in Sponsor’s sole opinion, corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes, (b) the Sweepstakes or any website associated therewith (or any portion thereof) becomes corrupted or does not allow the proper processing of entries per these Rules, (c) the Sweepstakes becomes corrupted due to interruption in wireless calling devices or wireless service for any reason, or (d) the Sweepstakes is otherwise not capable of running as planned. If Sponsor terminates the Sweepstakes, it will determine the winners of remaining Entry Period prizes by random drawing from among all eligible, non-suspect, non-winning entries received as of the termination date and it will determine the winner of the Grand Prize by random drawing from among all eligible, non-suspect, non-winning entries received as of the termination date. If Sponsor terminates or modifies the Sweepstakes, Sponsor will post notice on the official Sweepstakes website and announce the action on the 7-8 AM morning newscast. By entering, entrants represent that they are eligible and agree to be bound by and comply with these Rules and the decisions of any judges, which are final on all matters pertaining to the Sweepstakes. Any entrant who attempts to tamper with this Sweepstakes in any way or use fraudulent means to participate in and/or win the Sweepstakes will be disqualified if discovered by Sponsor. Sponsor reserves the right to disqualify any entrant at any time, for any reason, including, without limitation, language, activities or behavior deemed inappropriate. If a dispute arises regarding compliance with these Rules, Sponsor may consider, in its sole discretion, data reasonably available to Sponsor through information technology systems in Sponsor’s control, but Sponsor will not be obligated to consider any data or other information collected from any other source. Sponsor and its advertising and promotion agencies are not responsible for cancellations, postponements, or delays in the Sweepstakes. Other than the prizes received by the winners, no entrant will be entitled to receive any wages, benefits, fees or other compensation whatsoever as a result of participating in the Sweepstakes. Sponsor will have the sole discretion to administer the Sweepstakes and interpret and apply these Rules. This Sweepstakes is not intended for gambling. If Sponsor determines that an entrant is using the Sweepstakes for gambling purposes, such entrant may be disqualified and reported to the authorities. Neither the failure of Sponsor to insist upon or enforce strict performance of any provision of these Rules nor the failure, delay or omission by Sponsor in exercising any right with respect to any term of these Rules, will be construed as a waiver or relinquishment to any extent of Sponsor’s right to assert or rely upon any such provision or right in that or any other instance. If there is any discrepancy or inconsistency between any terms or conditions of these Rules and any disclosures or other statements contained in any other Sweepstakes-related materials, including but not limited to the Sweepstakes entry forms or advertising, the terms and conditions of these Rules will govern.

11. Indemnification/Hold Harmless: By participating, entrants agree: (a) to release, discharge, and hold harmless WDAF, Tribune Media Company, and their respective affiliates, parents, subsidiaries, advertising agencies, promotion agencies, and any other entity involved in the development or administration of the Sweepstakes and all of the officers, directors, employees, representatives, shareholders, and agents of the foregoing (the “Released Parties”) from all liability, injuries, losses or damages of any kind to persons, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright, or other intellectual property rights, death or property damage resulting in whole or in part, directly or indirectly, from the acceptance, delivery, possession, misuse or use of a prize (including any travel or activity related thereto), or from participation in and/or entry into or creation of an entry for the Sweepstakes and/or the broadcast or exploitation or use of entry or any other Sweepstakes-related activity; and (b) that the Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation or guaranty, expressed or implied, in fact or in law, relating to any prize.

12. Limitation of Liability: The Released Parties are not responsible or liable for: (a) any incorrect or inaccurate entry information or other errors in the printing, offering or administration of the Sweepstakes or in the announcement of the prize(s), (b) any error, omission, interruption, defect or delay in operation or transmission at any website, or wireless calling service, interrupted or unavailable network, server or other conditions, (c) failure of any entry to be received by Sponsor because of technical problems, telephone service problems, human error, or wireless calling service, (d) mechanical, technical, computer, hardware or software errors, malfunctions, or failures of any kind, or natural disasters or acts of God or man, which may limit an entrant’s ability to participate in the Sweepstakes, (e) communication line, hardware and/or software failures, malfunction of phones (including wireless phones/handsets), phone lines, other communications malfunctions, unavailable network connections, cellular equipment towers, telephone systems or wireless service, (f) damage to any computer (software or hardware) resulting from participation in the Sweepstakes, or damage to mobile phone or other PDA device, (g) theft or destruction of, tampering with, unauthorized access to, or alteration of entries and/or entry information, (h) entries that are late, lost, stolen, damaged, illegible, and/or unintelligible (or any combination thereof), or (i) any change of email address, mailing address, telephone number and/or any other contact information provided by entrant. Any expenses incurred by the entrant during the entry process, are the sole responsibility of each entrant and the Sponsor will not issue reimbursement for any expenses.

13. Names of Winners: For a list of prize winners, send a separate, self-addressed, stamped envelope to WDAF located at 3030 Summit, Kansas City, MO, 64108 or appear in person at that location between normal business hours (7:30 AM – 4:30 PM CT). Requests for winners list must be received by September 30, 2020.

Official Rules

NO PURCHASE NECESSARY TO ENTER OR WIN, NOR WILL A PURCHASE IMPROVE ONE’S CHANCES OF WINNING.

ALL FORMS MUST BE FILLED OUT COMPLETELY AND TRUTHFULLY. FAILURE TO COMPLETE THE ENTRY FORM AND PROVIDE TRUTHFUL AND PERTINENT INFORMATION MAY RESULT IN DISQUALIFICATION FROM THE SWEEPSTAKES. DISQUALIFICATION IS IN THE SOLE DISCRETION OF SPONSOR.

WDAF will conduct the FOX 4 Mug Shot Giveaway (“Sweepstakes”) in accordance with these Official Rules (“Rules”). Participation in the Sweepstakes constitutes entrant’s full and unconditional agreement to, and acceptance of, these Rules. The Sweepstakes is intended for play in the United States only and is void where prohibited and outside the Sweepstakes area set forth below. Do not participate if you are not eligible and not located in the United States at the time of entry.

Eligibility:Entrants must be legal US residents, at least 18 years old or above, as determined by WDAF and reside in the Kansas City Designated Market Area as defined by The Nielsen Company. Employees of WDAF and of its parent and affiliated companies (collectively, the “Sponsor”), the Sweepstakes’ participating sponsors, promotional agencies and advertising agencies, employees of other television or radio stations, and members of the immediate families of such persons are not eligible to participate and win. The term “immediate family” includes spouses, siblings, parents, children, grandparents and grandchildren and their respective spouses, and any other person residing at the same household whether or not related. Winning the prize is contingent upon fulfilling all requirements set forth herein.
Sweepstakes Period:The Sweepstakes begins on or about, June 4th, 2018 at 9:00 am CT and will continue until Sponsor announces the termination of the Sweepstakes (“Sweepstakes Period”). During the Sweepstakes Period, there will be one giveaway per week (each, a “Giveaway”), and each Giveaway will occur on a Monday (or Tuesday if Monday happens to be a holiday).
Sweepstakes Entry: To enter the Sweepstakes, watch the FOX 4 News at 9 AM each Monday during the Giveaway. During the news, go to fox4kc.com/category/contests or our Facebook page at: facebook.com/fox4kc/ and look for the “FOX 4 Mug Shot Giveaway” entry form. Accurately complete the entry form and submit the entry form. Entries must be received by 11:00 a.m. on the contest day. Entries will not roll over from one Giveaway to the next. Entrants must use their own name. Entrants may be required to become registered users of the WDAF website. Registration is free. Incomplete entries will be disqualified. Limit one entry per person and per email address per Giveaway; subsequent entries from the same person (even if using different email addresses) or a single email address will be disqualified if discovered by Sponsor. Multiple entries in one Giveaway by means of software-generated or other automated processes will be disregarded if discovered by Sponsor and may be voided in Sponsor’s sole discretion. Only one registered account per entrant. If multiple accounts are detected for a single entrant, the accounts will be voided and the entries disqualified in Sponsor’s sole discretion. If there is a dispute as to the identity of an entrant, the authorized account holder of the email address used to enter will be deemed to be the entrant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winner may be required to show proof of being the authorized account holder. The information that you provide in connection with the Sweepstakes will be used by Sponsor in accordance with its Privacy Policy, which is found at privacy.tribune.com and which may be updated from time to time.

Sponsor reserves the right not to run the Giveaway on a particular Monday because of the coverage of breaking news or other unforeseen circumstances. Should Sponsor choose not to run the Giveaway on a particular Monday, Sponsor may (but is not required to) run the Giveaway on a different day. Any schedule changes for the Giveaway will be listed on the WDAF website at fox4KC.com as soon as possible.

Winner Selection:One winner will be selected each day that a Giveaway is held by random drawing from among valid entries for that Giveaway. Winner will be subject to eligibility verification and compliance with these Rules. Odds of winning depend on the number of eligible entries. Sponsor will attempt to notify the Sweepstakes winner by email or phone. The winner must have a valid email address and telephone number where the winner can be notified. If the winner is unreachable or fails to respond to WDAF’s initial notification attempt within 24 hours, if winner fails to provide required information and documents by deadlines established by Sponsor, or if winner is found to be ineligible or otherwise not in compliance with the Rules, Sponsor reserves the right to award the prize to an alternate winner selected at random from among remaining eligible entrants for that Giveaway, time permitting. If Sponsor cannot verify winner, Sponsor reserves the right not to award the prize. All results are unofficial until winner is verified.
Prize:Each Giveaway winner will receive a FOX4 Morning News coffee mug. The approximate retail value of the prize is $12.00.
Prize Acceptance/Restrictions:Winner is subject to verification by WDAF of the winner’s name, age, address, phone number, and Social Security number (where the prize value is equal to or greater than $600.00). In order to claim his or her prize, winner must appear in person at the business offices of WDAF, located at 3030 Summit, Kansas City, MO during regular business hours on business days or FOX4 will mail the prize by USPS. Sponsor not responsible for loss, delay, or damage in delivery. Winner will be required to sign an Affidavit of Eligibility/Release of Liability and Publicity and may be required to provide a completed W-9, per Section 9 below. Prize cannot be redeemed for cash or substituted for any other items by winner. Prize is non-assignable and non-transferrable. Sponsor reserves the right to substitute a comparable prize of like or greater value, including cash, for prize, for any reason. Cost of transportation, where applicable, and any other cost not specifically included in the prize is the sole responsibility of the winner. Properly claimed prize will be awarded in each Giveaway, but in no event will Sponsor award more prizes than are provided for in these Rules.
Publicity Release:By participating in the Sweepstakes, each entrant acknowledges that his/her entry in the Sweepstakes constitutes that entrant’s consent to use, publish, reproduce and for all purposes in connection with the Sweepstakes, including publicity, promotion and advertising, in any media (including without limitation, the Internet, television or offline promotions), winner’s name, likeness, photograph, voice, opinions, and/or hometown and state, and any portion thereof, each extending throughout the universe and in perpetuity without further compensation, credit or right of review or approval, except where prohibited by law.
Taxes:Any valuation of the prize stated above is based on available information provided to WDAF, and the value of prize awarded to the winner may be reported for tax purposes as required by law. All taxes, including federal, state, and local taxes, are the sole responsibility of the winner. Any person winning over $600.00 in total prizes from WDAF in a calendar year will be sent a 1099 form from Sponsor at the end of the calendar year and a copy of such form should be filed with the IRS. Winner must provide Sponsor with valid identification, and a valid taxpayer identification number or Social Security number for total prizes valued at $600.00 or more, before prize will be awarded. Sponsor will have the right, but not the obligation, to require winner to complete and submit an IRS form W-9. Sponsor reserves the right to withhold prize until the completed W-9 form is received.
Conditions:Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend this Sweepstakes or any portion hereof, or to disqualify any individual implicated in any of the following actions, if: (a) infection by computer virus, bugs, tampering, unauthorized intervention, actions by entrants, fraud, technical failures, or any other causes that, in Sponsor’s sole opinion, corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes, (b) the Sweepstakes or any website associated therewith (or any portion thereof) becomes corrupted or does not allow the proper processing of entries per these Rules, (c) the Sweepstakes becomes corrupted due to interruption in wireless calling devices or wireless service for any reason, or (d) the Sweepstakes is otherwise not capable of running as planned. If Sponsor terminates the Sweepstakes during a Giveaway, it will determine the winner by random drawing from among all eligible, non-suspect entries received as of the termination. If Sponsor terminates or modifies the Sweepstakes, Sponsor will post notice on the official Sweepstakes website. By entering, entrants represent that they are eligible and agree to be bound by and comply with the Rules and the decisions of any judges, which are final on all matters pertaining to the Sweepstakes. Indemnification/Hold Harmless:By participating, entrants agree: (a) to release, discharge, and hold harmless Sponsor, Facebook, and the advertising agencies, promotion agencies, and any third parties involved in the development or administration of this Sweepstakes and all of their respective affiliates, parents, and subsidiaries, and the officers, directors, employees, representatives, and agents of each of the foregoing (the “Released Parties”) from all liability, injuries, losses or damages of any kind to persons, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright, or other intellectual property rights, death or property damage resulting in whole or in part, directly or indirectly, from the acceptance, delivery, possession, misuse or use of prize (including any travel or activity related thereto), or from participation in and/or entry into or creation of an entry for the Sweepstakes and/or the broadcast or exploitation or use of an entry or any other Sweepstakes-related activity; and (b) that the Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation or guaranty, expressed or implied, in fact or in law, relating to any prize.
Limitation of Liability:The Released Parties are not responsible or liable for: (a) any incorrect or inaccurate entry information or other errors in the printing, offering or administration of the Sweepstakes or in the announcement of the prize, (b) any error, omission, interruption, defect or delay in operation or transmission at any website, or wireless calling service, interrupted or unavailable network, server or other conditions, (c) failure of any entry to be received by Sponsor because of technical problems, telephone service problems, human error, or wireless calling service, (d) mechanical, technical, computer, hardware or software errors, malfunctions, or failures of any kind, or natural disasters or acts of God or man, which may limit an entrant’s ability to participate in the Sweepstakes, (e) communication line, hardware and/or software failures, malfunction of phones (including wireless phones/handsets), phone lines, other communications malfunctions, unavailable network connections, cellular equipment towers, telephone systems or wireless service, (f) damage to any computer (software or hardware) resulting from participation in the Sweepstakes, or damage to mobile phone or other PDA device, (g) theft or destruction of, tampering with, unauthorized access to, or alteration of entries and/or entry information, (h) entries that are late, lost, damaged, illegible, and/or unintelligible (or any combination thereof), or (i) any change of email address, mailing address, telephone number and/or any other contact information provided by entrant.
